Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Leash platform, including leash.build, the Leash CLI, APIs, and related services (collectively, the "Service"), operated by Leash ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

Leash provides a platform for building, deploying, and hosting web applications and static sites. The Service includes application hosting, deployment automation, environment variable management, and related infrastructure services.

4. Your Content and Applications

4.1 Ownership

You retain all rights, title, and interest in your source code, application data, and content deployed through the Service ("Your Content"). We claim no ownership over Your Content.

4.2 License to Operate

By deploying content through the Service, you grant us a limited, non-exclusive license to host, store, build, serve, and transmit Your Content solely as necessary to provide the Service. This license terminates when you remove Your Content or delete your account.

4.3 Responsibility

You are solely responsible for Your Content, including its legality, reliability, accuracy, and compliance with applicable laws. You represent that you have all necessary rights and permissions to deploy Your Content through the Service.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Deploy malware, phishing pages, or other malicious content
  • Distribute illegal content, including child exploitation material
  • Conduct unauthorized security testing against other users or systems
  • Mine cryptocurrency or run computationally abusive workloads
  • Send spam, phishing emails, or unsolicited communications
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent usage limits, billing controls, or access restrictions
  • Resell or redistribute the Service without our written consent
  • Scrape, harvest, or collect data from other users' applications without consent

We reserve the right to suspend or terminate your access and remove content that violates this policy, with or without notice.

6. Service Tiers and Billing

6.1 Free Tier

The free tier allows deployment of static HTML artifacts. Free tier services are provided as-is with no uptime guarantee.

6.2 Paid Plans

Paid plans are billed monthly through Stripe. You authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law or as otherwise stated in these Terms.

6.3 Plan Changes

You may upgrade or downgrade your plan at any time. Downgrades take effect at the end of the current billing period. If you downgrade below your current usage, existing applications will continue running but you will not be able to create new deployments until you are within your plan limits.

6.4 Payment Failure

If payment fails, we will attempt to collect for up to 7 days. After that period, your account may be downgraded to the free tier. We will notify you by email before any service disruption.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

8. Security

We implement industry-standard security measures to protect the Service and your data. However, no system is completely secure. You acknowledge that you use the Service at your own risk. You are responsible for securing your application code, managing access to your environment variables, and following security best practices in your deployments.

9. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Leash and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features except as expressly permitted.

10. Third-Party Services

The Service integrates with third-party services including Google Cloud Platform, Supabase, Stripe, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Leash and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

14. Termination

You may terminate your account at any time by deleting it through the dashboard or contacting us. We may terminate or suspend your access at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export Your Content before deletion.

15. Modifications

We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance. If you do not agree to the modified Terms, you must stop using the Service.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Delaware. Each party shall bear its own costs.

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

17. General

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Leash regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
